1. Acceptance of Terms

By downloading, installing, or using the ShotClock mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ShotClock ("we," "us," or "our") regarding your use of the App.

2. Description of Service

ShotClock is a mobile application designed to help users track and manage their GLP-1 medications (including but not limited to Ozempic®, Wegovy®, Mounjaro®, Zepbound®) and therapeutic peptides (including but not limited to BPC-157, TB-500, Ipamorelin, CJC-1295, and similar compounds). The App provides:

  • Medication and peptide injection tracking and scheduling
  • Dosage monitoring and reminders for all compounds
  • Weight and health metrics tracking
  • Side effect logging
  • Data visualization and reporting
  • Educational resources about GLP-1 medications and peptides

3. Medical Disclaimer

IMPORTANT: TRACKGLP1 IS NOT A MEDICAL DEVICE

  • The App is for informational and tracking purposes only
  • The App does not provide medical advice, diagnosis, or treatment
  • The App is not a substitute for professional medical advice, diagnosis, or treatment
  • Always seek the advice of your physician or other qualified health provider with any questions about a medical condition
  • Never disregard professional medical advice or delay seeking it because of something you have read or tracked in this App
  • If you think you may have a medical emergency, call your doctor or emergency services immediately

No Doctor-Patient Relationship

Use of the App does not create a doctor-patient relationship between you and ShotClock or any of its employees, contractors, or affiliates.

4. User Eligibility

To use ShotClock, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into binding contracts
  • Have a legitimate medical need for tracking GLP-1 medications or peptide therapies
  • Use the App only for lawful purposes and in accordance with these Terms

5. User Account and Responsibilities

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We recommend using biometric authentication (Face ID/Touch ID) when available

Accurate Information

You agree to provide accurate, current, and complete information when using the App. Inaccurate medication tracking could have serious health consequences.

Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Share prescription medications or encourage unsafe medication practices
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's operation
  • Reverse engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any proprietary notices

6. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

Data Ownership

  • You retain ownership of all health data you input into the App
  • You can export or delete your data at any time
  • We do not sell your health data to third parties

7. Intellectual Property Rights

App Ownership

The App and its original content, features, and functionality are owned by ShotClock and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

User Content

By using the App, you grant us a limited license to process and store your data solely for the purpose of providing the App's services to you.

8. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by ShotClock. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Information about specific medications is provided for reference only. Always consult your medication's official prescribing information and your healthcare provider.

9. Disclaimers and Limitations of Liability

As-Is Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKGLP1 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or death
  • Lost profits or revenues
  • Loss of data
  • Business interruption

Medical Outcomes

We are not responsible for any medical outcomes resulting from your use or inability to use the App. The App is a tracking tool only and does not replace professional medical care.

10. Indemnification

You agree to indemnify, defend, and hold harmless ShotClock and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any harm caused to others through your use of the App

11. Subscription and Payments

Free and Premium Features

The App offers both free and premium features. Premium features may require a one-time purchase or subscription.

Payment Terms

  • All purchases are final and non-refundable unless required by law
  • Prices are subject to change with notice
  • You are responsible for any taxes associated with your purchase

Auto-Renewal

If you purchase a subscription, it will automatically renew unless you cancel it before the renewal date.

12. Termination

Termination by You

You may stop using the App at any time by uninstalling it from your device.

Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Effect of Termination

Upon termination, your right to use the App will cease immediately. You may export your data before termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Updating the "Last Updated" date
  • Sending an in-app notification
  • Requiring your acceptance before continued use

Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

15. General Provisions

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and ShotClock regarding the use of the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
